ALERT: Ukraine: IP rights registration fees to increase from 19 July 2019

From July 19, 2019, the cost of registration of intellectual property (IP) rights in Ukraine will increase three-fold on average.

The changes were introduced by
the Cabinet of Ministers Regulation No. 496 on June 12, 2019 (“Resolution
496”).
In particular, the new minimal fees for application for registration of IP rights
will be:
– trade mark registration:                     USD 173 (currently USD 43)
– industrial design registration:          USD 72 (currently USD 36)
– invention registration:                        USD 302 (currently USD 151)
– utility model registration:                  USD 113 (currently USD 38)

 

Advice: file your application before the date of the increase
New fees come into force on July 19, 2019. Until this date, current fees apply. Therefore, we recommend filing applications for registration of your IP rights before this date. This will be particularly important for businesses that operate with a large portfolio of trademarks or those who use advanced types of trademarks.
Example:
If you are going to file 10 applications in one class of goods (Nice classification), you may save about USD 1 132. The same amount will be saved for each additional class of goods, if you chose to apply for registration in more than one class of goods/services.

Please note, however, that you will be only able to save on fees for filing of the application. The complete registration procedure includes other fees payable at different stages of the registration procedure, most notably the fees for publication of the decision on registration of IP rights and for issuance of the certificate of registration or a patent (see our previous Newsletter on trademark registration in Ukraine for details). Those fees are also increasing from July 19, 2019.

Still, if you have other registration process fees, including trademark or patent prolongation fees that are already payable or may be payable to Ukraine’s IP registration authority, you may save your IP protection budget by paying the fees before July 19, 2019.

Electronic application discount
Resolution 496 promotes the transition from paper application filing to electronic filing. For example, a discount of 20% will be available for filing an application for a trademark’s registration in electronic form.

Expected improvements in the registration procedure
It is planned that additional funds raised from this fee increase will be used to improve the work of the existing online database of the Ukraine’s IP rights authority.

It is also anticipated that the increase in fees will decrease the number of applications and therefore will enable the IP authority to process applications faster.
